Terms & Conditions

0. General 

Quotations allow for work to be carried out during normal office hours (unless stated) 9:00 to 17:00 Monday to Friday excluding Bank Holidays, with uninterrupted access required.

Any discovery of asbestos or other toxic substances shall be cleared or decontaminated at no cost to Active Communications.

Penetration through any fire barriers will be reinstated using appropriate fire stop materials.

Our engineers are prepared to move office desks and furniture. Any of which that require dismantling or special lifting shall remain the responsibility of the customer.

No allowance has been made for the removal and replacement of racking within storage areas (unless stated).

Patching in the cabinets, jumpering and the plugging in of any data or telephone equipment at wall/floor outlets does not come under the scope of this quotation (unless stated).

The recovery of any redundant cabling or equipment does not come under the scope of this quotation unless stated above (unless stated).

A signed quotation or purchase order with our reference will approve the installation as per the quoted price & components and will confirm unequivocal acceptance of these terms and conditions.

By signing a quotation or forwarding purchase order, the signatory/sender confirms they have the absolute authority to enter purchase agreement contracts on behalf of the individual or business named on the quotation in accordance with Part 4 of the Companies Act 2006.

All prices quoted are in pound sterling and exclusive of VAT that will be charged at the current rate.

  1. Applications of Conditions

All estimates, quotations, services and goods supplied by ACTIVE COMMUNICATIONS LIMITED, (herein referred to as “the seller”), are subject to these conditions and no variation will apply unless agreed in writing by a director of the seller.

  1. Prices

All prices are subject to VAT at the rate applicable at the date of invoice. The seller reserves the right to alter prices without notice and the new prices will be advised at the time of placing an order. Unless otherwise stated in writing all quotations are valid for 30 days from the date shown on the quotation.

  1. Settlement Terms

Unless otherwise agreed in writing in advance of acceptance of order, all goods & services are payable on completion of installation or receipt of delivery, unless, invoiced on account. Invoices on account are due for payment strictly 30 days from the invoice date. The seller reserves the right to charge interest on all unpaid sums at the rate of 3% per calendar month. In addition, the seller reserves the right to charge at cost any and all third party costs incurred in the recovery or attempted recovery of any unpaid invoices.

  1. Availability of Goods

Most items offered are of ex-stock. Should any items ordered by the buyer be out of stock, these will be placed on back order for shipment when possible. The seller shall not be liable for any consequences, whether of a financial nature or not, of any delay for any reason, in fulfilling or attempting to fulfil the buyers’ order.

  1. Damage in Transit

The seller will replace any goods proven faulty upon arrival at the buyers’ address. All such claims must be made by telephone and confirmed in writing or by email within 3 days of receipt or no claims will be entertained.

  1. Guarantee on Goods Supplied

Unless otherwise stated in writing the warranty on all goods supplied will be limited to material failure or defective workmanship for a period of 12 months from the date of dispatch. If goods should prove to be defective and accepted as such by the seller, arrangements should be made with the seller who, at their discretion, may replace them or refund the price paid. No warranty will apply to goods that have been modified or altered in any way or to goods to which unauthorised repairs have been made.

  1. Discrepancy

If upon receipt of goods the buyer has any discrepancy in comparison to the order placed, the buyer must notify the seller of the discrepancy in writing within 3 days of the date of receipt, failing which no claim in respect of the discrepancy will be entertained by the seller.

  1. Return of Goods

Goods may only be returned to the seller by prior arrangement. Goods returned for any reason other than being faulty or defective must be unused, in saleable condition and in the original packaging, sent freight paid to the seller. Such returns will be subject to a minimum 10% handling charge. Goods that have been specially modified or purchased for a buyer may not be returned for credit in any event. No returned goods will be accepted more than 30 days after the goods were dispatched.

  1. Descriptions

The photographs, illustrations, dimensions, specification and type numbers quoted are only as a guide. The seller will endeavour to supply the exact product required but the seller reserves the right to supply similar items of detail difference. Continued product development dictates product appearance & performance may vary slightly.

  1. Accuracy and Rights of Information

The seller makes every effort to ensure the information quoted is accurate but accepts no liability for any loss, damage or injury arising directly from any error or omission in such information. Unless agreed to the contrary by the seller in writing, no representation, particulars or statements made shall form any part of any contract.

  1. Reservation of Title

In all dealings the following clauses shall apply: All goods sold by the seller shall be and remain the property of the seller until the purchase price and any other payments are paid in full. In addition, all goods shall remain the property of the seller until all sums are paid in full irrespective of any subsequent sale to any third party and irrespective of the appointment of any receiver or liquidator. In addition, the seller shall be entitled and the buyer hereby grants the seller licence to enter upon the premises of the buyer during normal business hours for the purpose of removing such goods from the buyers’ premises in the event of non-payment within the terms specified.
